Failure to Pay Student Loans Led to the Arrest of a Texas Man
February 23, 2016
According to CNNMoney, Paul Aker was arrested after failing to appear in court in December of 2012 for failure to pay back his federal student loan. U.S. Marshalls had made multiple attempts since 2012 to server Aker with a summons to court, even checking several addresses.
The Marshal service said it talked to Aker by phone in 2012 requesting he appear in court, a claim that Aker denies.
According to CNNMoney, a student load is considered delinquent after 90 days go by without payment and is considered in default after 9 months without payment.
After a loan is defaulted on, a collection agency is involved in the process. It can garnish wages and the government can hold tax returns, but the agency cannot arrest the person in debt.
If a person fails to appear in court for failing to pay the loan, he or she can then be arrested.
